When you create an EVOLVERE account or use our website, you agree to be bound by these terms and conditions when you use or interact with our website in any form.

 

     EVOLVERE is a platform that aims to support individuals as they work to build and maintain positive mental health. At EVOLVERE, our philosophy aligns with the notion that we are all lifelong learners who can use tools that we have cultivated through personal and taught experiences to optimize our mental health and productivity. EVOLVERE provides individuals with a platform to help them grow and learn independently or as a part of the EVOLVERE community, and to share their knowledge with other EVOVLERE community members. Our goal is to help individuals integrate the tools that they have learned in classrooms and through experiences with the tools that other students and professionals have learned, and to apply them in different ways to optimize EVOLVERE community members' mental health and productivity across all domains in their lives.

 

     Please read EVOLVERE's Privacy Policy and our Community Guidelines prior to using our website, and continue to refer to them and this policy as you continue to use our website.

     The following Terms and Conditions are to govern your use of our website:

1. Agreeance With Our Terms and Conditions

​

     Your access to and use of our website indicates that you have read, understood, and agreed to be bound by these Terms and Conditions and all applicable laws and regulations every time that you visit and use our website. By agreeing to these Terms and Conditions you also recognize, understand, and consent to our Privacy Policy and Community Guidelines, and recognize that any violation of these agreements may be met with consequences including but not limited to account limitations, suspensions, or termination.

     These Terms and Conditions are effective as of April 20th, 2020, and will remain in effect with respect to any modifications or updates in the future. We reserve the right to modify or update our Terms and Conditions and will notify you of any such alterations to our Terms and Conditions either by contacting the email address that you have provided us or by posting a prominent notice on our webpage. Any changes or modifications to these Terms and Conditions will be immediately posted to this page on our website, so please revisit this page regularly. 4. EVOLVERE Accounts

​

     We do not charge you to use EVOLVERE. Individuals who choose to create an account with EVOLVERE become members of the EVOLVERE community by providing their valid and operational email address and a password to make an account. To create an EVOLVERE account, you must be over the age of thirteen. Having an account enables community members to enjoy the content displayed on this website, create their own content, and interact with other EVOLVERE community members. We assume no responsibility or liability for any misrepresentation in your EVOVLERE account.

5. Protection of Privacy

​

     Through using our website, you are providing us with information that we may use in Canada and any other country where we may operate. We use the information that you have provided us to ensure your continued positive experience on our website and with our services. We may also track certain information to improve our marketing and analytics, a process that involves third-party partners. If you would like to disable our access to any passive information that we may receive, you may disable cookies in your web browser. Please be aware that disabling your cookies will still give us access to the information that you provide us to create your EVOLVERE account.

     If you choose to terminate your EVOLVERE account, we will store information related to you for a reasonable amount of time to be determined by us in accordance with regional laws. After this period, all information relating to you will be thoroughly deleted.

     Your agreeance with these Terms and Conditions indicates that you agree that all internet communications are subject to interception, loss, or alteration, which means that any and all personal information or data that we actively or passively obtain electronically is not entirely confidential or exclusive, except to the extent that is required by law.

     Your privacy is of the utmost to us. We will continue to work on ways to increase our security and ensure your privacy.

6. Advertisements

     By creating an EVOLVERE account and using our website, you are agreeing that we can show you advertisements. We at EVOVLERE may accept advertising and sponsorships from commercial businesses or receive other forms of advertising compensation. EVOLVERE may also engage in affiliate marketing through our website, through which we may receive a commission on or percentage of any resulting sales.

7. Intellectual Property

     All intellectual property that is shared on our website (except for content that is generated by EVOLVERE community members) is owned solely by EVOLVERE. Our intellectual property includes, but is not limited to, content in the form of text, designs, graphics, sounds, music, videos, applications, and interactive features. Our content may be shared by any individual on any form of media, as long as the content is unaltered, the content is not used for a purpose outside of its original context, and EVOLVERE is visibly referenced. Any modification to our intellectual property, by any party, should be clearly indicated. Nothing in these Terms and Conditions may be interpreted as granting the rights of any EVOLVERE owned intellectual property to any individual. All rights reserved.

8. User-Generated Content

​

     EVOLVERE defines “user-generated content” as materials, information, data, text, opinions, photos, profiles, messages, notes, communications, website links, text information, designs, graphics, sounds, music, videos, features, and any other form of content that any member of the EVOLVERE community posts, shares, or otherwise makes available on our website, except to the extent that the content is owned by EVOLVERE. Any form of modification to any of EVOLVERE’s intellectual property does not give the modifier any rights to the property.

9. EVOLVERE Account and Account Use

​

• The EVOLVERE community member to whom the account is registered is solely responsible for their account, the maintenance, confidentiality, and security of their account, all passwords related to their account, and all activities that occur under their account.

• EVOLVERE community members agree to immediately notify us of any unauthorized use of their account or any other breach of security with respect to their account or any service provided through it. EVOLVERE community members also agree to assist us, as requested, in all of our efforts to stop or remedy any breach of security related to their account.

• EVOLVERE community members agree to provide true, accurate, current, and complete information, as requested by us, and to promptly notify us of any change to their information, so as to endure that their information is kept current, complete, and accurate.

10. Reverse Engineering and Security

​

     Agreeing to these terms and conditions indicates that you agree not to reverse engineer or attempt to reverse engineer or disassemble any code or software related to or affiliated with EVOLVERE, or violate the security of our website in any way.

11. Data Loss

​

     We are not responsible for the security of your EVOLVERE account or any content that you post or share. Your use of our website is at your own risk.

12. Indemnification

​

     By agreeing to these Terms and Conditions you agree that you will defend and indemnify EVOLVERE, our website, and any of our affiliates, and hold us harmless against any and all legal claims and demands, including reasonable attorney’s fees, which may arise for any reason including any and all reasons relating to your use of or actions relating to our website. We will select our own legal counsel and may participate in our own defence if we wish to do so.

13. Service Interruptions

     We may need to interrupt your access to our website to perform maintenance or other services. These service interruptions may be scheduled or unscheduled. Agreeing to these Terms and Conditions indicates that you agree to these service interruptions, and to EVOLVERE not being liable for any damages or losses caused as a result of interrupted access to our website.

14. Termination of Account

     EVOLVERE may, of our sole discretion, choose to suspend, restrict, or terminate your EVOLVERE account and your access to our website, effective at any time, without notice to you, for any reason including the violation of our Community Guidelines, justified complaints on your account, your misuse of our website, if we find you to be in violation of our Terms and Conditions, or if we find you to be in successive violation of our Community Guidelines. We have no responsibility to notify any third parties of the suspension, restriction, or termination of your account or access to our website, except within the requirements of the law. Once an EVOVLERE account has been terminated, the account holder is not able to use our website or any other EVOLVERE services in the future.

     Agreeing to these Terms and Conditions shows that you recognize that your use of our website is solely at your risk, and that any service that we provide to you is on an as is basis. We disclaim any and all warranties of all kinds related to our website. We make no warranties that our website will meet your needs, or that our website will be error-free, secure, and uninterrupted. We make no warranties to the reliability or accuracy of all content found on our website. Any damage or loss that you may experience through any interaction or use of our website is your sole responsibility, and EVOLVERE is not liable or responsible in any way for any such damage or loss.
